Implemented in April 2013, new Government rules aimed to tackle the so-called growing compensation culture by changing the ways in which compensation claims are paid for. These have made referral fees illegal, so make sure you avoid any claims companies offering them to you, as if they are willing to take part in an illegal practice, a claim made with them may be compromised.

 

In order to tackle the allegedly growing number of compensation claims reported by insurance companies, it has been decided that the claims process must not be free of charge for the party making the claim (the Claimant). As of April 2013, Claimants are required to pay for “After the Event” insurance cover for the claim and must surrender a percentage of their damages towards their own legal costs at the end of their successful claim.

 

All Claimants must face the unfortunate prospect of paying part of their compensation fees towards the cost of making their claim. The days of a Claimant keeping 100% compensation or receiving an additional cash incentive along with their compensation are in the past.
